Content & Likeness Policy
How OVERSTIMULATED LIVE records, clips, and monetizes audio from live rooms — and how participants can opt out or request takedowns.
1. What we record
OVERSTIMULATED LIVE hosts live audio rooms on third-party social audio platforms (such as Clubhouse). Rooms hosted by the Company may be recorded in full using the platform's native replay feature. Selected segments ("Clips") may then be edited and offered for sale or free streaming on OVERSTIMULATED LIVE.
2. Consent to recording and clipping
By speaking on stage, joining as a co-host, or remaining in a room hosted by OVERSTIMULATED LIVE after the in-room consent announcement is read, you grant Overstimulated LLC a non-exclusive, royalty-free, worldwide license to record, edit, distribute, monetize, and promote audio of your voice and stated username from that room. This license is limited to audio captured inside Company-hosted rooms. It does not extend to your image, photographs, name outside of your stated username, or any content you create outside the room.
3. What is NOT included
We do not claim ownership of: • Your underlying ideas, opinions, or intellectual property • Content you create outside OVERSTIMULATED LIVE-hosted rooms • Audio in which you are clearly inaudible, anonymized, or unidentifiable We do not clip or sell: • Private medical, legal, financial, or other sensitive disclosures • Content shared in rooms explicitly designated as "off the record" • Content involving minors
4. Opt-out and takedown
You may opt out of being clipped at any time. Two paths: Proactive opt-out — Email Dahome@overstimulatedch.com with the subject "LIKENESS OPT-OUT" and your handle. Going forward, any Clip in which you are an identifiable speaker will not be published. Already-published Clips are handled under the takedown process below. Takedown request — If a published Clip features your voice and you want it removed, email Dahome@overstimulatedch.com with the subject "CLIP TAKEDOWN", a link to the Clip, and the timestamp of your segment. We will remove the Clip from sale within 72 hours of a verified request and pull it from streaming within 7 days. Refunds for prior purchases of removed Clips are at the Company's discretion.
5. Featured speakers and recurring guests
Speakers who appear regularly, are billed as featured guests, or whose voice is the primary subject of a Clip may be asked to provide one-time written consent via a separate Speaker Release. That release governs in addition to this policy.
6. Public figures and commentary
Discussion, commentary, criticism, and parody of public figures, public events, and publicly available content is protected speech. OVERSTIMULATED LIVE may publish Clips containing such commentary without separate consent from the public figure being discussed, consistent with U.S. fair use and commentary law.
7. Audience members (non-speakers)
If you are in a room but never come up to the stage, your voice is not captured and this policy does not apply to you. Your username may incidentally appear in a Clip's metadata (e.g., room attendance count) but is not the subject of the recording.
8. Revenue
Clip sales generate revenue for Overstimulated LLC as the producer, editor, host, and distributor of the recording. By default, individual speakers do not receive revenue share from Clip sales. Featured speakers and recurring guests may negotiate a revenue share via a separate Speaker Release.
9. Platform rules
This policy is in addition to — not in place of — the terms of the underlying social audio platform (Clubhouse, etc.). You remain bound by that platform's terms of service and recording rules.
10. Disputes
Good-faith disputes about a specific Clip should first be sent to Dahome@overstimulatedch.com. We will respond within 7 business days and aim to resolve directly before any third-party action.
